As Donald Trump and his allies continue to target federal judges, former prosecutor Norm Eisen makes one thing clear: The U.S. Constitution is stronger than Trump’s attacks on the judiciary.
Eisen, who served as special counsel to the House Judiciary Committee during Trump’s first impeachment trial (2019–2020), views Article Three of the Constitution as an unshakable safeguard against growing political pressure.
"The judiciary is the guardrail of our democracy," Eisen stated this morning.
"Courts have already ruled that Trump cannot retaliate against the 6,000 FBI agents involved in the January 6 investigation. And just this week, we saw another major decision: Elon Musk and his agency, DOGE, were found to have acted unconstitutionally when they – as Musk himself put it – ran USAID ‘through the shredder.’”
Showdown with the Justice Department
Eisen’s pointed remarks come at a critical moment: The Department of Justice is under pressure to provide a federal judge with detailed information regarding deportation flights to Venezuela. The case has gained nationwide attention, especially after Trump openly called for Judge James Boasberg’s impeachment.
Yet Eisen remains unfazed by the former president’s threats.
“The bottom line is: They’re losing in court. And I have no doubt that Judge Boasberg – whom I’ve known for three decades – will impose consequences. And he should.”
Eisen’s confidence stands in stark contrast to ongoing efforts by Trump’s allies to curtail the power of federal courts. As political tensions rise, one thing remains certain: The judiciary’s independence is being put to the test – and in this battle, it may prove to be Trump’s toughest adversary.
