The Administered Human – Kilmar Abrego Garcia and the New Face of American Diplomacy

On April 21, 2025, submitted before the United States District Court for the District of Maryland, a man named Michael G. Kozak delivered a sworn declaration. Its content: Kilmar Abrego Garcia, deported under the pretext of national security, was reportedly “in good conditions and excellent health” at the Centro Industrial in Santa Ana, according to Salvadoran authorities. Not a word about rights. Not a word about a hearing. Only the verdict: confined – and healthy.

DECLARATION OF MICHAEL G. KOZAK

I, Michael G. Kozak, declare under penalty of perjury pursuant to 28 U.S.C. § 1746 as follows:

Please refer to my prior declaration regarding my position and the basis of my knowledge of the relevant facts in Abrego Garcia v. Noem, Case No. 8:25-cv-00951-PX (D. Md. Apr. 13, 2025), paragraphs 1–2.

On April 20 and 21, our Ambassador requested an update from the Salvadoran government regarding the physical placement and custodial status of Mr. Abrego Garcia. The Salvadoran government responded on April 21 that Mr. Abrego Garcia was being held at Centro Industrial, a correctional facility in Santa Ana - "in good conditions and in excellent health."

I declare under penalty of perjury that the foregoing is true and correct.

What Kozak submitted to the court is not a protective affidavit. It is proof of a new principle: The human being is no longer a subject of law, but an object of administration. As long as the body survives, the system is considered intact. As long as there are no visible wounds, there is no scandal.

In Trump’s America, it is no longer the dignity of the human being that counts, but their position in the file. The administered human breathes, eats—and loses the right to resist. A body in order is not a case. It is a notation.

And somewhere in Santa Ana, a man counts the days, while America declares that all is well—but the fight goes on, for him and for the many others.
