The Next Victory: Judge Stops Renewed Detention - Government Fails With Deportation Plan Against Kilmar Abrego Garcia

Federal Judge Paula Xinis of the U.S. District Court for the District of Maryland has prohibited immigration authorities from detaining Kilmar Abrego Garcia again. The statutory 90-day period for removal detention has expired, and there is no realistic plan for his removal from the United States, Judge Paula Xinis ruled on Tuesday. Abrego Garcia, a national of El Salvador, was mistakenly deported to his home country last year - even though an immigration judge had already determined in 2019 that he faced danger there from a gang. After public pressure and a court order, he was brought back in June. Shortly thereafter, the government filed charges in Tennessee alleging human smuggling. Abrego Garcia denies the allegations.

Since his return, the Department of Homeland Security has attempted to deport him to other countries - including Uganda, Eswatini, Ghana or Liberia. In her decision, the judge speaks of "empty threats." There is no reasonable basis to believe that a deportation will be possible in the foreseeable future. Another point is noteworthy: Costa Rica has repeatedly offered to accept Abrego Garcia as a refugee, and he is willing to go there. Nevertheless, the government has ignored this offer without explanation.

The Department of Homeland Security reacted sharply. If this had been about law or procedure, Abrego Garcia would have long since been deported, it said in a statement. The judge will not be satisfied until he is allowed to remain in the United States permanently. Removal detention is not a substitute for punishment, but serves exclusively to prepare an actual removal. Without a realistic destination country, continued detention is unlawful. Abrego Garcia has lived in Maryland for years, has an American wife and a child. His case now stands as a symbol of a broader dispute: How far may a government go when it seeks to enforce deportation - and when does administrative action tip into arbitrariness.
