You make an example of the strong. With the weak, hardly anyone would notice. Audrey Cromwell had what is supposed to protect people from arbitrary power in this country: an elected office, and the credentials of a lawyer and respected Montana citizen. Republican Attorney General Austin Knudsen still took her hand off the wheel of her own office. When a hand reaches that high, everyone below watches and calculates what could happen to them. That was exactly the point.<\/p>\n\n\n\n

Her offense was knowing the law. In October, Enforcement and Removal Operations, the unit of Immigration and Customs Enforcement responsible for arrests, detention and deportations, demanded confidential criminal case records on a resident of Gallatin County. Because deportation is a civil matter under federal law and does not involve a criminal offense, an attorney in Cromwell's office responded that a court order would be required before the records could be released. Knudsen turned that one sentence into a scandal. In a press release, he claimed she had \"secretly\" introduced a sanctuary city policy and gave her 5 days to reverse it. There was no such policy, and there had been no message from him either. She learned about the accusation from a reporter calling her.<\/p>\n\n\n\n

The punishment came on April 30. Knudsen placed her office under \"supervisory control\" after rejecting her invitations to take responsibility himself for handling such requests. This rarely used authority, whose limits remain unclear, allows him to supervise an elected county attorney and overturn her decisions. By then, this was no longer about the records of one man. The point was to show that the attorney general's hand could reach into an elected office and take the wheel there.<\/p>\n\n\n\n

She was chosen deliberately. Cromwell, a Democrat, had defeated a Republican incumbent in 2022 after 26 years in office. During her first week, she found 3 boxes of untouched criminal cases sitting in a closet, and later hundreds more. She expanded the chronically understaffed office from 6 to 46 attorneys and cleared more than 600 backlogged cases in a single year, including 113 involving sexual assault, 52 of them involving children. An office that was finally working lost control over itself. \"I was so concerned that I took all my personal belongings home,\" she said, pointing to bare walls and an empty windowsill.<\/p>\n\n\n\n

The July 8, 2026 letter shows how Montana Attorney General Austin Knudsen publicly and administratively pressured County Attorney Audrey Cromwell. The immediate issue was a criminal case involving Christopher Wardle, in which Knudsen called a negotiated plea agreement far too lenient and accused Cromwell's office of sending a dangerous message to perpetrators of domestic violence. He explicitly cited public outrage and criticism from the Bozeman police union. At the same time, Knudsen acknowledged that his own office had not previously been involved in the case and that only the judge handling the case could still reject the agreement. Even so, he demanded that Cromwell submit by July 31 a written report explaining her standards for such agreements, along with a list of every case involving domestic violence, strangulation and related offenses that had been dismissed or resolved by agreement since January 2022. The letter shows very clearly how Knudsen used individual decisions by an elected county attorney as grounds to demand sweeping accountability for the entire record of her office.<\/p>\n<\/blockquote>\n\n\n\n

Knudsen knows how to wield an office like a club. Since being elected attorney general in 2020, after previously serving as a county attorney and as speaker of the Montana House of Representatives from 2015 to 2019, he has made the hard hand a habit. On one occasion, he sent a Highway Patrol officer to St. Peter's Health Hospital in Helena because relatives of a Covid patient had unsuccessfully demanded ivermectin for him. In December 2025, a professional disciplinary court cleared him of a 41-count complaint stemming from his disparaging remarks about the judiciary. He did not respond to requests for comment.<\/p>\n\n\n\n

Helena showed what the intimidation was meant to accomplish. In February, Knudsen accused the state capital of violating Montana's ban on sanctuary cities because it had set out its rules for cooperation with ICE in a resolution and rejected a voluntary 287(g) agreement that would have opened local police forces and detention facilities to the agency. Standing beside him at the news conference was Governor Greg Gianforte. \"There will be penalties,\" he said. \"In Montana, we do not tolerate resistance, and we support our local law enforcement.\" The numbers behind the threat were meant to land: $10,000 for every 5 days of refusal, plus the loss of state infrastructure funding if a municipality failed to comply within 14 days. Helena spent at least $17,000 on lawyers and withdrew the resolution in March anyway, even though its own attorneys believed it was lawful. Getting Helena to cave before a court could rule was the goal.<\/p>\n\n\n\n

Montana only shows what is being practiced in many places. Republican attorneys general have used state laws and loud public campaigns to push municipalities into cooperating with ICE, said Cassandra Charles, senior attorney at the National Immigration Law Center; they make the threats so loud that most officials cave before the issue ever reaches a judge. In Texas, Attorney General Ken Paxton, now running for the U.S. Senate, pressured Dallas County Sheriff Marian Brown to enter into a 287(g) agreement and opened a formal investigation into her when she refused. In Georgia, private property owners can now sue municipalities themselves if they believe local governments are not being tough enough on migrants and homeless people. Melinda Reed, the only Helena commissioner who voted against withdrawing the resolution, described where this can lead: today immigration, next time maybe water rights.<\/p>\n\n\n\n

The people who pay are those who do not have lawyers. The resident whose records ICE wanted stands at the beginning of this story and has no name in it. The popular mechanic whom the agency held for more than 100 days was lucky in his misfortune because the sheriff of a conservative small town mobilized neighbors to support his family. In a state that votes Republican roughly 60 to 40, 59 percent want local police to cooperate with ICE, and yet they still want their own neighbor back. This toughness knows its price and seeks it anyway, because the fear itself is the payoff. \"There is almost something cruel about it,\" University of Montana political scientist Rob Saldin said about the new tone of his party, \"maybe that is exactly the point.\"<\/p>\n\n\n\n

\nThe look toward Saxony-Anhalt makes the comparison uncomfortable.<\/strong>\nThere is already far more to see there than a theoretical parallel to Montana. The AfD wants local immigration offices to move from a \"welcoming culture\" to a \"departure culture,\" push deportations with its own task force and take naturalization authority away from municipalities. Associations and institutions could lose funding if they help prevent the deportation of rejected asylum seekers; for other public funding, even a commitment to the democratic order would no longer be enough, with an additional \"patriotic attitude\" demanded. Ulrich Siegmund has announced that, if the AfD takes power, 150 to 200 positions in the state administration would be filled with new people if officials there tried to \"block\" the work of an AfD government. The domestic intelligence service is also supposed to be fundamentally restructured. This is exactly where Saxony-Anhalt touches the Audrey Cromwell case in Montana: you do not have to remove every opponent from office, and you do not have to win every case. It is enough to show a few people, visibly, what resistance can cost. When money, jobs, authority and government supervision become political pressure tools, the effect begins long before anyone enters a courtroom. Mayors, agency heads, civil servants or associations already know what risk they are taking if they do not fall in line. The danger does not begin only when the law is broken. It begins in the moment before that, when people start censoring themselves because they have seen what happened to others.\n<\/div>\n\n\n\n

The fight has a measurable price. The Montana Supreme Court has not yet ruled on the supervisory authority, the proceedings have eaten up more than 80 hours of Cromwell's time and cost taxpayers thousands of dollars. In November, voters in Gallatin County will decide whether to give her a second term, against a Republican challenger backed by the Republican sheriff. Asked whether Knudsen had staged the whole thing as a spectacle for Election Day, Cromwell left the answer hanging in a single word: \"Show.\" Many expect him to run for governor in 2 years, in a state Trump has won three times by an average of 18.7 points. What happens, constitutional law scholar Constance Van Kley of the University of Montana asked, when one elected official is allowed simply to override the mandate of another?<\/p>\n\n\n\n

Her own question carries further than any ruling. \"If the attorney general is willing to come after me this way,\" she said, \"and I am an elected official, an attorney, a privileged Montana resident, what is he willing to do to people who have no power?\" The answer writes itself once you picture the bare walls of her office and the man who spent more than 100 days in detention. Cromwell has already made her decision before any court does. She said she is a voice for the voiceless in this office, and she is willing to put herself on the line for it.<\/p>\n\n\n\n
