Tariffs are not paid by foreign governments. That sentence ought to be nailed to the wall of every newsroom that has spent the last 17 months repeating Trump's announcements as if the bill were landing in Beijing or Brussels. Tariffs are paid by American companies that import goods, and they pass those costs straight on to the checkout counter, where a mother in Ohio wonders why her kid's shoes just got more expensive again. Beginning at 12:01 a.m. this Friday, that will apply to goods from more than 80 countries, with rates ranging from 10 to 12.5 percent, taking effect the very minute the previous duties expire. Not a business day without another tariff. Not a shopping trip without another price hike.<\/p>\n\n\n\n

The latest round is being justified by forced labor. Other countries, the administration claims, have failed to ban imports produced through forced labor or failed to enforce those bans. Follow that argument to its conclusion and the real cruelty comes into view. A person trapped in a factory, sewing without pay and with no way out, is now being used to justify making products from that country more expensive, reducing orders, and putting even more jobs at risk. That person is exploited twice, first as labor, then as an excuse, and the second time may cost them even the job they never chose to do. Anyone who borrows someone else's suffering to disguise their own advantage has not liberated the victim. They have simply found another way to profit from them.<\/p>\n\n\n\n

The list of countries being punished completely exposes the excuse. Canada already bans imports produced through forced labor and is still hit with a 10 percent tariff. The European Union has passed its own ban, which takes effect in December 2027, and it too is being hit with 10 percent. The gap between those countries and China is remarkably small. That narrow gap, says a Georgetown law professor who previously served in government, shows that the investigation is simply a pretext for tariffs Trump wanted anyway. This was never really about forced labor. Meanwhile, inside the United States, prisoners continue working under conditions that labor unions describe as forced labor.<\/p>\n\n\n\n

The people paying the highest price are the poorest, on both sides of the ocean. A tariff is a consumption tax, and consumption taxes hit people who spend every dollar they earn far harder than people who invest their wealth. Someone making $3,000 a month feels every increase in the price of clothes, tools, and coffee immediately. Someone worth $3 million barely notices it in their year-end financial statement. On the other side are the exporting countries, many of which depend almost entirely on a handful of textile factories for employment. When the orders disappear, the factory closes, and the woman behind the sewing machine is left with nothing, all in the name of protecting her.<\/p>\n\n\n\n

How cynical the entire system really is becomes clear once you read the list of exemptions. Oil and natural gas are spared. Certain raw materials, fertilizers, goods covered under the North American trade agreement, and products already subject to national security tariffs on cars and steel are also exempt. In other words, the administration excluded exactly those products whose higher prices voters would notice within days at the gas pump or on the farm. The burden falls on products whose higher costs spread quietly through household budgets over time, while anything capable of triggering an immediate political backlash is left untouched. This is not economic policy. It is a calculation of how much pain the public will tolerate three months before the November 3 midterm elections.<\/p>\n\n\n\n

An incident from February shows where the money goes when it comes back. The Supreme Court ruled that Trump's first tariff scheme was unlawful and ordered roughly $160 billion to be refunded. That money goes back to the companies that paid the import duties. The family that paid higher prices at the checkout gets nothing because they do not exist anywhere in the tariff paperwork. The government took the money from ordinary Americans, the court gave it back to corporations, and hardly anyone considers that worth mentioning. That is what a refund looks like in a system that does not even recognize the people who actually paid.<\/p>\n\n\n\n

The administration's treatment of the law follows the same pattern. Four different legal authorities in 17 months for the exact same policy. First came an emergency powers law, struck down in February. Then a provision dealing with balance-of-payments problems, something never before used to impose tariffs, limited to 150 days, struck down in May by the U.S. Court of International Trade after small businesses and a coalition of states sued. The administration appealed and has continued collecting tariffs ever since. Now it is relying on Section 301 of the Trade Act of 1974, a law intended to address a single unfair practice by a single country, now being used against dozens of countries at once. The justification keeps changing. The tariffs remain. When the law has to be dressed up four different ways while the policy never changes, it is no longer a safeguard. It has become nothing more than a wardrobe.<\/p>\n\n\n\n

Before the Senate, the U.S. Trade Representative insisted it would be inappropriate to prejudge the ongoing investigations. Behind closed doors, however, administration officials had already assured several foreign governments that their tariff rates would remain the same as those agreed to in last year's deals. The outcome of the investigation was settled before it even began. And the administration has already calculated its lead over the courts. According to the Georgetown law professor, the message is simple: show that the executive branch can move faster than the judiciary and force the courts to spend their time chasing decisions that have already taken effect.<\/p>\n\n\n\n

This week's most remarkable move reaches furthest back into history. To justify 50 percent tariffs on billions of dollars' worth of Canadian exports, the administration turned to a law from 1930, the same tariff law Congress passed at the beginning of the Great Depression in an attempt to protect American industry, a law many historians believe only deepened the economic collapse. The specific provision being used had never before been invoked to impose tariffs. <\/p>\n\n\n\n

A president is reaching for the most famous economic failure in American history and treating it as if it were a fresh idea.<\/p><\/blockquote><\/figure>\n\n\n\n

Back then, farmers lost their land because exports collapsed and other countries retaliated. That history has no place inside this White House because it would get in the way of today's announcement.<\/strong><\/p>\n\n\n\n

The damage that comes without a price tag barely gets noticed. A company building a factory plans ten years ahead. If it has no idea whether one of its key components will be hit with a 10 percent tariff, a 50 percent tariff, or no tariff at all six months from now, it does not build. It waits. It delays. It cancels. Those decisions never show up in any economic statistic, yet they are the real destruction, and they hit precisely the manufacturing sector the administration claims it wants to revive. Predictability is the cheapest thing a government can provide, and this one has abolished it. In all of this, the very chamber the Constitution assigns responsibility for trade is simply bypassed. The power to regulate commerce belongs to Congress. Congress granted the president limited exceptions for individual countries and specific industries, not the authority to replace an entire nation's tariff system by himself. Americans are therefore paying a tax their elected representatives never voted on. Taxation without representation. That was once the phrase on which this country built its independence.<\/p>\n\n\n\n

And retaliation comes the way it always does. Countries that impose tariffs end up facing tariffs in return, and it is America's own exports that take the hit, soybeans from Iowa, machinery from Michigan. In 1930, American farmers lost their land because other countries struck back. The president announces his tariffs as though he alone controls global trade. The response from the other 80 countries does not come with a press conference. It simply arrives. The most honest statement came from the U.S. Trade Representative before Congress on Wednesday. The specific legal authorities may have changed, he admitted, but the trade strategy has not. The administration will continue using tariffs to reindustrialize the economy, protect workers, and raise wages. The worker is being protected from inexpensive shoes he will soon no longer be able to afford. Another proposal covering 15 additional countries and the European Union is already waiting.<\/p>\n\n\n\n

In the end, what remains is a country sealing itself off in the hope of becoming stronger, only to become more expensive instead, led by a man who knows just enough about history to recognize its greatest mistakes and mistake them for successes. The bill will not be paid by some foreign government. It will be paid by the seamstress whose factory shuts down and by the woman standing at a checkout counter in Ohio who never learns that she has just paid a tariff that a court may declare unlawful a year from now, only to watch her money be refunded to someone else.<\/p>\n\n\n\n
