Since the White House largely eliminated the possibility of bond hearings and moved toward mandatory detention, thousands have turned to an old legal remedy: habeas corpus. The result is a flood of filings that even experienced judges describe as an emergency. In Georgia, a federal judge at the end of January declared an \u201cadministrative judicial emergency.\u201d Despite clear rulings against blanket detention, the administration has continued to deny individualized hearings. Instead, the court must intervene in each individual case. In Minnesota alone, more than 400 habeas petitions were filed in January. The Chief Judge there stated that apparently no preparations were made for this wave.<\/p>\n\n\n\n<p>In New York as well, a federal judge reported that the court was \u201cflooded\u201d with petitions from people who posed neither a flight risk nor a danger, yet were being held indefinitely. A 52 year old woman from Guinea was released after a successful petition. His words sound like a warning: the state may pursue deportations, but how it treats people matters. The Department of Homeland Security rejects the criticism and speaks of \u201cactivist judges.\u201d An appeals court in the 5th Circuit recently upheld the policy of detention without bond. At the same time, attorneys accuse the administration of ignoring a nationwide ruling against mandatory detention.<\/p>\n\n\n\n<p>Several courts are responding with emergency measures: automatic orders for detention hearings, stays of deportation upon filing of a petition, and special procedural rules. The conflict is thus shifting from the border fence to the courtrooms. The trigger was several bomb threats explicitly directed at the Haitian population. The governor said the messages carried the clear message: \u201cGet rid of the Haitians.\u201d Unlike earlier threats that turned out to be purely online hoaxes, suspicious packages were found this time at two locations. Bomb squads and detection dogs were deployed, the FBI responded, and streets were sealed off. Hours later, the city gave the all clear. There was no longer an immediate threat.<\/p>\n\n\n\n<p>Springfield has been at the center of the immigration debate for months. More than 10,000 Haitians have settled there in recent years, many arriving during the pandemic to work in auto supply plants, warehouses, and healthcare. When the federal government sought to end Temporary Protected Status, fear grew. A federal judge temporarily halted the move and the administration appealed. Even before the court ruling, many families kept their children home from school out of fear. Now evacuations and renewed threats have followed. In the fall of 2024, the city had already experienced more than 30 bomb threats within a few days after unsubstantiated claims about Haitians spread nationwide. The situation remains tense. The legal future of many Haitians is uncertain, and the case could reach the Supreme Court.
